Kole Higgins, 24, of Grand Junction was sentenced Oct. 12 to three five-year prison terms after he was found guilty at a jury trial of possession with intent to deliver marijuana, failure to affix a tax stamp, and sponsoring a gathering for the use of controlled substances. The first two terms are concurrent, but consecutive to the third term. They were suspended and he was placed on probation for three years. He was fined $750 with a $262.50 surcharge, a $10 drug abuse resistance education (DARE) surcharge, and a $125 Law Enforcement Initiative surcharge; the fines and surcharges were suspended.
Higgins was also found guilty of two counts of illegal possession of prescription drug. He was sentenced to 90 days in jail on one, and on the other he was sentenced to reside in a residential correctional facility until he obtains the maximum benefits. On those counts he was fined $315 with a $110.25 surcharge, a $10 DARE surcharge and a $125 LEI surcharge. The fines and surcharges were suspended.
In total, Higgins must pay $625 in LEI surcharges, $50 in DARE surcharges, and $241.90 court costs. (Sentencing: Honorable Joseph B. McCarville)
Nicholas Weber, 18, of Jefferson was granted a deferred judgment after he changed his plea to guilty to two counts of burglary- third degree. He was placed on probation for two years. He must pay a $625 civil penalty on both charges (one suspended) and a $125 LEI surcharge on both charges. He must also pay $1,200 restitution for his court appointed attorney’s fees and $257.85 court costs. Weber was originally charged with burglary- third degree, burglary- third degree motor vehicle (eight counts), and theft- fourth degree. (Sentencing: McCarville)
A case against Douglas James Bumgardner, 18, of Jefferson in which he was charged with possession of marijuana was dismissed Sept. 25 with the state to pay court costs. Bumgardner pleaded guilty in magistrate court to a charge of possession of drug paraphernalia. He was fined $100 with a $35 surcharge. He must pay $300 restitution for his court appointed attorney’s fees and $60 court costs. (Sentencing: McCarville)
Jordan Marie Teeples, 19, of Jefferson was sentenced to two days in jail after she changed her plea to guilty to a charge of possession of marijuana. The jail term was suspended and she was placed on unsupervised probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Teeples was fined $315 with a $110.25 surcharge, a $10 DARE surcharge and a $125 LEI surcharge. She must also pay $500 restitution for her court appointed attorney’s fees and $100 court costs. Joseph Aaron Pritchard, 27, of Fort Dodge was sentenced to two years in prison after he changed his plea to guilty to a charge of driving while license barred. Chad Christopher Louk, 42, of Jefferson was sentenced to 60 days in jail after he changed his plea to guilty to a charge of assault causing bodily injury. Jerry Dean Barker, 54, of Grand Junction pleaded not guilty at arraignment to a charge of possession of methamphetamine with intent to deliver and possession of a firearm as a felon. A trial date was set for Oct.30.
